Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and Pocket Labs LLC ("Cruise," "we," "us," or "our") governing your use of the Cruise app and related services. By downloading, creating an account, or using Cruise, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use Cruise.

2. Eligibility

You must be at least 13 years old (or the minimum age in your country) and, to use driving features, a validly licensed driver operating a vehicle you are legally permitted to drive.

3. Your Account

You are responsible for the accuracy of your account information and for keeping your account secure. You are responsible for all activity under your account. Notify us promptly of any unauthorized use.

• One account per person. Do not create multiple accounts to manipulate leaderboards, streaks, or referral rewards.
• Sign-in methods. Cruise uses Sign in with Apple and Google Sign-In. If you lose access to that provider you may lose access to your account, as we hold no separate password.
• Deleting your account. You can permanently delete your account at any time from Settings → Account → Delete Account. Deletion is immediate and irreversible, and removes your trips, posts, comments, friendships, and convoy membership. It does not cancel an active subscription — cancel that separately in your Apple ID settings.
• Inactive accounts. We may remove accounts that have been inactive for an extended period after giving reasonable notice to the email on file.

4. License and Acceptable Use

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use Cruise for your own non-commercial use, subject to these Terms. You agree not to: break any law while using the app; reverse engineer, decompile, or tamper with the app; disrupt or overload our systems; scrape or harvest data; impersonate others; or use Cruise to harass, endanger, or harm anyone.

5. User Content

You retain ownership of the content you post (drives, photos, captions, comments). By posting, you grant Cruise a worldwide, non-exclusive, royalty-free license to host, store, display, reproduce, and distribute that content for the purpose of operating and promoting the service. You are solely responsible for what you post and confirm you have the rights to share it. Do not post content that is unlawful, infringing, hateful, harassing, sexually explicit, dangerous, or that promotes reckless or illegal driving. We may remove content and suspend or terminate accounts that violate these Terms. You can block users and report content in the app.

6. Convoys and Live Location

Convoy and live-location features share your real-time location and driving status with the members of your convoy. Only join convoys with people you trust, and use Ghost Mode if you prefer to hide your live location.

• Nearby drivers. While you are actively driving, other Cruise users near you can see your approximate position and profile. You stop appearing once you park.
• Convoy members can see your live location for the duration of the convoy, including while you are parked. Leave the convoy to stop sharing.
• Ghost Mode removes you from the map for everyone, including your convoy, while your own drives keep recording privately.
• Do not use location sharing to follow, surveil, intercept, or harass anyone. Doing so is a serious violation of these Terms and may be unlawful. We will terminate accounts used this way.
• Location sharing depends on GPS and network conditions and may be delayed, inaccurate, or unavailable. Never rely on it for safety or in an emergency.

6a. Leaderboards, Scores, and Records

Leaderboards, driving scores, streaks, top speeds, and 0–60 times are provided for entertainment only. They are derived from consumer GPS and phone sensors, are not calibrated instruments, and may be inaccurate. Nothing in them is an invitation to speed or to drive competitively on public roads.

• We may recalculate, correct, reset, or remove any score, record, or leaderboard entry — for example when it results from a GPS error, a modified device, or an attempt to game the system.
• Submitting fabricated or manipulated drive data is a violation of these Terms.
• Records set on closed circuits or private land are your responsibility to obtain permission for; we do not verify where a drive took place.

7. Cruise Pro Subscriptions

Cruise offers optional auto-renewing subscriptions ("Cruise Pro"). Payment is charged to your Apple ID at confirmation of purchase. Subscriptions renew automatically for the same period at the then-current price unless you cancel at least 24 hours before the end of the current period. You manage and cancel subscriptions in your Apple ID settings; deleting the app does not cancel a subscription. Except where required by law or Apple's policies, payments are non-refundable.

• What Pro includes. Access to your full trip history, detailed statistics and comparisons, and other features identified in the app at the time of purchase. The specific feature set may change as the app develops.
• Free trials and introductory offers, where available, convert to a paid subscription automatically unless cancelled at least 24 hours before the trial ends. Eligibility is determined by Apple.
• Price changes. If we change the price, Apple will notify you and, where required, ask you to consent before the next renewal. You may cancel instead.
• Refunds are handled by Apple, not by us. Request them through Apple's support. Statutory withdrawal or cooling-off rights, where they apply to you, are unaffected.
• If your subscription lapses, your drives and data remain intact; only Pro-gated views become unavailable until you resubscribe.

7a. Vehicle Connections (OBD-II)

Cruise can connect to a compatible Bluetooth OBD-II reader to display data your vehicle reports. You are responsible for using an adapter that is safe and appropriate for your vehicle, and for any effect connecting one has on it. Do not plug in, unplug, or configure an adapter while driving. Vehicle data is provided by your car and its adapter; we do not verify its accuracy, and Cruise must never be used in place of proper servicing or a mechanic's diagnosis.

8. Third-Party Services

Cruise relies on third-party services (including Apple, Google, Mapbox, Supabase, RevenueCat, and Superwall). Your use of those services may be subject to their terms, and we are not responsible for third-party services or content.

8a. Apple-Specific Terms

These Terms are between you and Pocket Labs LLC only, not with Apple. Apple is not responsible for Cruise or its content. You acknowledge that:

• Apple has no obligation to furnish any maintenance or support for Cruise.
• If Cruise fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price, if any. To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever.
• Pocket Labs, not Apple, is responsible for addressing any claim relating to Cruise, including product liability, failure to conform to legal requirements, and consumer protection claims.
• Pocket Labs, not Apple, is responsible for investigating and resolving any third-party claim that Cruise infringes that party's intellectual property rights.
• You represent that you are not located in a country subject to a US Government embargo or designated a "terrorist supporting" country, and are not on any US Government restricted-parties list.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

8b. Not a Safety, Navigation, or Driver-Assistance System

Cruise is an informational and entertainment product. It is not a safety system, an advanced driver-assistance system, a collision-avoidance system, a certified speedometer, or an emergency service. Speed readings come from consumer GPS and are not calibrated; they may differ from your vehicle's speedometer and must never be relied on to judge whether you are driving lawfully. Speed-camera and hazard alerts are community and third-party data, are frequently incomplete or out of date, and their absence never means none is present. Never rely on Cruise to keep you safe.

8c. Assumption of Risk

Driving is inherently dangerous. You knowingly and voluntarily assume all risk arising from your driving and your use of Cruise, including risks arising from distraction, reliance on inaccurate data, and any decision you make in response to something the app displayed. If you are dissatisfied with Cruise, your sole and exclusive remedy is to stop using it.

9. Disclaimer of Warranties

Cruise is provided "AS IS" and "AS AVAILABLE," without warranties of any kind, whether express, implied, or statutory, including any warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the app will be uninterrupted, error-free, or that any data (including maps, routes, speeds, or alerts) will be accurate or reliable.

10. Limitation of Liability

To the fullest extent permitted by law, Cruise and Pocket Labs LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or for personal injury, death, property damage, accidents, or traffic citations, arising out of or relating to your use of the app. To the extent liability cannot be excluded, our total liability is limited to the greater of the amount you paid us in the 12 months before the claim or 50 US dollars.

11. Indemnification

You agree to indemnify and hold harmless Cruise and Pocket Labs LLC from any claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the app, your content, your driving, or your violation of these Terms or any law.

12. Termination

You may stop using Cruise and delete your account at any time. We may suspend or terminate your access if you violate these Terms or to protect the service and its users. Sections that by their nature should survive termination will survive.

13. Governing Law and Disputes

These Terms are governed by the laws of the State of [Your State], United States, without regard to conflict-of-laws rules. Any dispute will be resolved in the courts located in that jurisdiction, unless otherwise required by applicable law.

13a. Dispute Resolution and Class Action Waiver

Informal resolution first. Before starting a formal proceeding, email contact@pocketlabsteam.com describing the dispute. We will try in good faith to resolve it within 60 days.

Binding individual arbitration. If we cannot resolve it informally, any dispute arising out of or relating to Cruise or these Terms will be settled by final and binding arbitration administered under the rules of a recognised arbitration provider, before a single arbitrator, in the English language. Judgment on the award may be entered in any court of competent jurisdiction.

Class action and jury trial waiver. Disputes will be brought only in your individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. You and Pocket Labs each waive the right to a jury trial.

Thirty-day opt-out. You may opt out of this arbitration agreement by emailing contact@pocketlabsteam.com with the subject line "Arbitration Opt-Out" within 30 days of first accepting these Terms. Opting out does not affect any other part of these Terms.

Excluded claims. Either party may bring an individual claim in small-claims court, and either party may seek injunctive relief in court to protect intellectual property rights.

Statute of limitations. Any claim must be brought within one year of the events giving rise to it, except where a longer period is required by law.

If any part of this section is found unenforceable, the remainder stays in force, except that if the class-action waiver is unenforceable this entire section does not apply to that dispute. Nothing here limits rights you have under mandatory consumer-protection law in your country of residence.

13b. Force Majeure

We are not liable for any failure or delay caused by events beyond our reasonable control, including acts of God, natural disasters, war, terrorism, labour disputes, government action, power or internet failures, or the failure of a third-party provider such as Apple, Google, Supabase, or Mapbox.

13c. General

• Severability. If any provision is held unenforceable, the rest remains in effect.
• No waiver. Our failure to enforce a provision is not a waiver of it.
• Assignment. You may not assign these Terms. We may assign them in connection with a merger, acquisition, or sale of assets.
• Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and Pocket Labs regarding Cruise.
• Survival. Sections concerning user content licences, disclaimers, limitation of liability, indemnification, and dispute resolution survive termination.

14. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you in the app and update the "Last updated" date. Your continued use after changes take effect means you accept the updated Terms.
